Terms of contract

The following general terms and conditions apply for orders and shipment of goods you have ordered over the internet in the Fun-Care Shop.

The general terms and conditions are valid solely in relation to these services.


Order and Payment

We will send you an E-mail confirming your order on reception. Payment is by credit card or Swiss Postcard. COD and customs fees are not included in the price, but are payable in the form of a supplementary charge. All prices are in CHF or EURO and include postage and packaging unless otherwise indicated.


Dispatch

Orders are delivered by post. Postage costs are included in the price unless otherwise indicated. If you wish your order to be delivered by express post or courier, a supplementary charge is payable for the transport costs.


Delivery

1. In the absence of any prior agreement, the merchandise is delivered ex warehouse. We do not guarantee availability of the ordered goods. If we are not able to deliver the ordered goods, we will contact you.

2. The deadlines named by Fun-Care AG are indicative only. Fun-Care AG strives to dispatch ordered merchandise to the customer within 3 workdays. If the merchandise cannot be dispatched within four weeks from the order date, you may retract from your order in the absence of any prior agreement.

3. If you fail or refuse to take delivery of the merchandise within the set deadline, Fun-Care AG may either resind the contract or demand compensation for breach of contract. Fun-Care AG may demand ten per cent of the full order price in compensation. The onus is on you to prove that Fun-Care AG has not suffered any, or little, damage.


Claims

Damage during transport, if discernible, must be certified on reception by post of the merchandise. Claims must be made immediately, at the latest 5 days after reception of the merchandise, either orally or in writing. After this time, damaged merchandise can neither be replaced nor returned. Delivery is at the customers own cost and risk. We insure all shipments against transport damage on payment of an insurance premium. In the absence of insurance, you are liable for any possible transport damage. Merchandise returned to us under guarantee must be returned carriage paid.


Right to return unwanted goods

Besides the current legislation of rescission, should the merchandise fail to please Fun-Care AG entitles you to return it by registered post within ten days of delivery. This does not apply in the case of used, unpacked or damaged merchandise. The costs of returning the merchandise are payable by you.


Privacy Policy

You can control and/or delete cookies as you wish – for details, see aboutcookies.org. You can delete all cookies that are already on your computer and you can set most browsers to prevent them from being placed. If you do this, however, you may have to manually adjust some preferences every time you visit a site and some services and functionalities may not work.


Warranty

For original purchasers, Fun-Care AG guarantees for ordered products two years from the date of purchase against defects due to faulty material or workmanship. The guarantee conditions are indicated on the warranty card enclosed with the airboard. Should the warranty card be missing, the buyer is bound to inform Fun-Care AG immediately in order to obtain a valid card.


Brand-name protection

The product and company logo may not be used without permission. They may not be used for advertising or commercial purposes without our prior written consent.


Reservation of ownership

The delivered merchandise remains the property of Fun-Care AG, CH-6300 Zug until full payment has been received.
